In Rhode Island the Gun Control Lobbies will be out in full force to restrict our Second Amendment Rights during the 2017 legislative session. This page is for you to find information on the bills and executive actions aimed at restricting gun ownership in Rhode Island.


2017 General Assembly Legislation

We will list the Bills as they become available. Please call and e-mail your State Representative for House Bills and State Senator for Senate Bills. We must be vigilant in telling our legislators to vote against any BAD gun control legislation and for GOOD bills.

 

H 5067 AN ACT RELATING TO CRIMINAL OFFENSES — WEAPONS Introduced By: Representatives Amore, Regunberg, Blazejewski, Kazarian, and Ajello

(BAD)

Lowers the bar of what legally disqualifies firearm ownership from those convicted of domestic assaults. We’re giving this a bad-to-neutral rating because it based on a criminal act but can be manipulated in some cases.

H 5115 - AN ACT  RELATING TO CRIMINAL OFFENSES — GENERAL PROVISIONS Introduced By: Representatives Ajello, Regunberg, Knight, Blazejewski, and Craven

(BAD)

The bill seems to have good intentions against assaults committed with firearms. The problem is there are numerous ways this could be abused to place felony charges against firearm owners and hunters due to the no injury clause.

As hunters we can see this as a major problem with bird hunting. We’ve seen increase in anti-hunters harassing legal hunts in recent years. If this passes it would be possible for anti hunters to claim being hit by bird shot without any injuries or PROOF. This could be charged as a felony assault.

H 5155 – AN ACT RELATING TO CRIMINAL OFFENSES –WEAPONS Introduced By: Representatives Regunberg, Kazarian, Donovan, Ranglin-Vassell, and Knight

(BAD)

House bill 5155 will ban magazines over 10 rounds including those already in your possession. You will have 120 days to remove them from the state or turn into police.

H 5262 – AN ACT RELATING TO CRIMINAL OFFENSES — WEAPONS Introduced By: Representatives Diaz, Slater, Williams, and Maldonado

(BAD)

This bill basically changes the law so that rifles and shotguns are scrutinized like pistols. It places a heavy burden to prove you are coming to and from a lawful recognized activity like hunting or target shooting if pulled over.

H 5154 AN ACT RELATING TO CRIMINALS — CORRECTIONAL INSTITUTIONS Introduced By: Representatives Vella-Wilkinson, Casey, Johnston, Lima, and Cunha

(BAD)

Firearm crimes would not be eligible for parole. We DO NOT want to protect violent criminals but this bill is not clearly worded as such. As the laws in RI are today we really don’t have an issue with this bill BUT the wording needs to be clearer as we’ve seen registration bills, lead bans, magazine possession, and dizzying rifle regulations proposed in RI. If any of those were to become law simple clerical or gray area violations could put non violent firearm owners in prison.

H 5547 AN ACT RELATING TO CRIMINAL OFFENSES — POSSESSION OF FIREARMS BY MINORS Introduced By: Representatives Williams, Diaz, Perez, Handy

(BAD)

This bill has been introduced for over a decade, but has failed to gain traction. Still, they keep introducing it. It will do NOTHING to reduce gun violence among minors, but will only make it difficult for teenagers who want to hunt and target shoot legally.

H 5608 AN ACT RELATING TO FISH AND WILDLIFE – HUNTING AND HUNTING SAFETY Introduced By: Representatives Bennett, Kazarian, Hull, Lombardi, and Amore

(BAD)

This bill will require any person who sustains an “injury” to themselves or causes an injury to another while hunting or trapping to report the injury to the department of environmental management immediately. The problem is there is no definition to “injury” and it is unreasonable to expect that the DEM needs to know about every little minor injury that happens while hunting.

H5730 AN ACT RELATING TO CRIMINAL OFFENSES – WEAPONS Introduced By: Representatives Slater, Hearn, Kazarian, and Diaz

This bill will require applicants for a license or carry permit for firearms to undergo a national BCI. We don’t see the point of this since this is already done and the hoops most people have to jump through is much more than a background check.

Companion Bill To H 5345

This bill would ban concealed carry holders from school property a right currently in place.  This bill completely alienates vetted and qualified people including those who carry for a career ! Example firearm can’t be on the school property to pickup a child, this would include your vehicle in a school driveway or parking lot.

S 0376 AN ACT RELATING TO CRIMINAL OFFENSES — WEAPONS Introduced By: Senator Maryellen Goodwin

(BAD)

This bill will prohibit anyone convicted of a misdemeanor Domestic Violence offence from purchasing, owning, or possessing a firearm. RIFOL does not condone domestic violence, but the problem with this bill is that the definition of domestic violence is very vague and even a “verbal disagreement” could be considered domestic violence. It is a pretty tough penalty to take away someone’s Second Amendment rights for a verbal argument and we can not think of another Constitutional right that is lost over a misdemeanor offense.

This bill will severely restrict where rifles and shotguns can be carried to a point that it can be more restrictive than for handguns. It will affect law abiding gun owners who wants to participate in otherwise lawful activities.

This bill will make it illegal to alter any identification marks (not necessarily serial numbers) on a firearm.

Provides for the legal purchase of stun guns in RI and allows concealed carry under a pistol permit.

This bill makes changes to possession of firearms by minors.

 

S 0379 AN ACT RELATING TO STATE AFFAIRS AND GOVERNMENT – DEPARTMENT OF ATTORNEY GENERAL – GUN CRIMES REPORT Introduced By: Senators Archambault, Ruggerio, McCaffrey, Lombardo, and Lombardi

(NEUTRAL)

For several years we have heard the argument that we need stricter gun laws to reduce the gun crimes in RI. However, we know that too often the gun charges are dropped and we have to ask ourselves why we need stricter gun laws if they will only affect the law abiding citizens and not reduce gun crimes. This bill will require the AG to provide an annual gun crime enforcement report.

 

H 5248 AN ACT RELATING TO TAXATION – SALES AND USE TAXES – LIABILITY AND COMPUTATION Introduced By: Representatives Fellela, Lima, Costantino, Corvese, and Serpa

(GOOD)

Tax Exempt Gun Safes – CT and MA already have this. Promotes the purchase of secure firearm storage by removing the sales tax

H 5081 AN ACT RELATING TO FISH AND WILDLIFE – BIRDS Introduced By: Representatives Corvese, Phillips, Coughlin, and Azzinaro

(GOOD)

Companion Bill To S 0110

These bills remove legal restriction blocking the use of crossbows for turkey hunting. DEM would still need to change the hunting regulations to allow crossbow use for turkeys but until it is lifted from state law DEM does not have that option.

This bill will lift the restriction on the ban on silencers for rifles and shotguns and allow them to be used for hunting.
